Why is my insurance adjuster acting unprofessional?
I was injured in when a car rear ended me. Her insurance company paid the doctor and physical therapy bills and reimbursed me for medication while treated by the PT. I suffer tinnitus which is horrible. The doctor prescribed anti anxiety and depression meds. to cope with the terrible buzzing. Now when I take my receipts into the office the adjuster is never available. (over a month now). The adjuster will be there but they tell me the adjuster is out of the office. The adjuster finally phoned after a month and said the check was in the mail. No check arrived. At first the adjuster would simply cut a check for the meds. Now it is obvious the adjuster is forcing me to hire an attorney.

When you take your receipts to the office…..do you call first and set up an appointment or do you just show up?
Because, when you just show up…it’s possible that the adjuster is out of the office and/or not available. But that’s the risk you run when you decide to just show up.
It’s also possible that something has happened (storms, someone quite, etc) that has caused claim counts to spike through the roof so the adjuster is handling more than they were 1 month ago and the adjuster is just not available when you just happen to drop in.
So….don’t just drop in any more.
Call and set up an appointment with the adjuster for a date and time that you will come by. That way, the adjuster can be sure to be in the office when you come.
I’m assuming this isn’t your adjuster – this is the adjuster for the other person’s insurance.
They have NO duty of good faith towards you.
Before you go and throw your money away on an attorney, you probably need to file the claim with YOUR insurance under your pip or medical payments.
HOWEVER, tinitus is NOT usually related to an auto accident, and mental health issues – PTSD, anxiety, depression – are ALSO not covered under bodily injury liability.
They want you to sue them, because THEN, they can request all your prior medical records. And if there’s ANY history of tinitus, or any mental health issues like anxiety or depression, they are flat out off the hook for paying you anything for them.
If not, you’ll have to PROVE, that medically, the tinitus was caused by the accident – which is pretty darned hard, because it isn’t caused by accidents. It’s nerve damage inside your head, usually caused by medications you’ve taken, or tumors. And you still won’t be able to collect for any of the mental illness part.
