How much settlement to expect from auto accident?
Involved in an auto accident in Oregon 10/2008. Other driver was at fault. Hit me on the freeway doing 100MPH and totaled my car. Both myself and the other driver are fully insured. 000 compensated to total my 1995 BMW. Going to physical therapy for 10 months for back pains. Going to neurologist for coclia damage (inner ear fibers) which has caused tinnitus. I have a 24/7 ringing in my ears which is most likely going to be permanent damage I will have to live with. 00 for a neurological device to sooth the ringing which really just keeps me from going insane. I cannot go camping and avoid silent area’s like the plague because the ringing is so intense. I am probably up to k-k in medical expenses. I missed approximately 1 week of work, plus having to take time off for all the doctors appointments.
What can I expect in settlement beyond my medical being covered for pain, suffering and permanent discomfort/ damage to my inner ear?

You need to find out what the policy limits are from their insurance carrier. You may have an underinsured claim.
fyi: there is no formula for bodily injury settlement. The at fault carrier will ask you to sign medical authorizations so they can gather your medical records in regards to treatment. Yet, you can only attempt to get their policy limits….
the policy will pay UP TO THE LIMIT OF THE POLICY. and you need to know how much that is, because when it’s exhausted, the insurance company has no more to do with it. if the cochlea is damaged, I can see it overrunning the policy limits. after the policy is exhausted, you would sue the other driver directly.
When it comes to things like pain and suffering, each case is heard on its own merits, and there is no formula to determine the amount. If anyone tells you there is a formula, they are severely uninformed.
Your best source of information will be your insurance agent.
In any case, you can’t expect insurance to pay any more than the policy limit.
